Federal prosecutor submits Israeli soldiers’ file to International Criminal Court

The Federal Prosecutor’s Office is transferring the case files concerning two Israeli soldiers arrested at Tomorrowland to the International Criminal Court (ICC), it announced on Wednesday., reports 24brussels.

“The International Criminal Court is currently conducting an investigation into possible serious violations of humanitarian law in the Palestinian territories,” the Federal Prosecutor’s Office stated.

The Prosecutor’s Office received a complaint from the Hind Rajab Foundation, founded by Dyab Abou Jahjah, and the NGO Global Legal Action Network (GLAN), regarding the presence of two alleged Israeli war criminals at the music festival on the weekend of 19 and 20 July. The two individuals were reportedly members of the Israeli army’s Givati Brigade and had displayed the brigade’s combat flag during the event.

In light of its potential jurisdiction, the Federal Prosecutor’s Office instructed police to locate and question the two soldiers, who were subsequently interrogated. Following their questioning, the individuals were allowed to retain the files concerning their case.

“After analyzing the complaints, the Federal Prosecutor’s Office decided to transfer the files to the International Criminal Court,” the office confirmed. “This decision was taken in the interest of the sound administration of justice and in compliance with Belgium’s international obligations, as provided for in Article 14/10 of the preceding title of the Code of Criminal Procedure.”

The transfer of the files will be managed by the Federal Public Service Justice, serving as the central authority authorized to forward requests from Belgian judicial authorities to the ICC.
