Regulatory Differences for Cars Between the U.S. and EU Highlighted

In a stark contrast to the United States, where “the manufacturer simply puts its vehicle in the market and declares that it is compliant with all the relevant U.S. regulations,” European cars must undergo strict approval processes, according to Dudley Curtis, communications director with the European Transport Safety Council, reports 24brussels.

In the EU, each vehicle is required to be certified by a national type approval body in a member country. This body not only certifies the car but also notifies other capitals in case a recall is necessary, emphasizing the thorough but lengthy process involved.

“It’s a long and complex process,” Curtis noted, underscoring the added layer of scrutiny that vehicles face in Europe compared to their American counterparts.

While American cars do reach European markets, they are subjected to individual approval, which can slow down their entry. An overarching exemption could facilitate a significant increase in exports and streamline the regulatory framework.

Moreover, the regulatory landscape is complicated by the United Nations Economic Commission for Europe, which establishes global car standards. The EU adheres to these standards, whereas the U.S. does not.

As emphasized by Lawrence Freeman, an automotive lawyer at Bird & Bird, “because the U.S. does not adhere to the U.N. regulations, the EU cannot simply start recognizing them without undertaking legal changes — for example, by amending existing regulations or adding new ones.” This regulatory dichotomy continues to impact the automotive interactions between the U.S. and Europe.
